Terms of Use

1. Acceptance of Terms

By accessing or using the UMMA app and related services (collectively, the "Service") operated by UMMA Foundation ("we," "our," or "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of the Service

UMMA is a mobile and web platform that helps communities stay connected through announcements, events, campaigns, conversations, and optional features such as donations and local business directories. Community admins create and manage their spaces; members join and participate according to each community's guidelines.

3. Eligibility and Accounts

You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and update it as needed.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

• Violate any applicable law or the rights of others.
• Harass, abuse, defame, or post content that is illegal, harmful, or offensive.
• Impersonate others or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use the Service to send spam or malware, or to interfere with its operation.

Community admins may set additional rules; you must comply with those rules when participating in a community.

5. Your Content and Licenses

You retain ownership of content you post ("Your Content"). By posting it, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute Your Content as needed to operate and improve the Service (for example, showing posts to your community and backups). You represent that you have the right to grant this license and that Your Content does not infringe third-party rights.

6. Payments and Fees

UMMA is free for community members and for communities to launch. When you make donations or other payments through the Service, a platform fee (for example, 2.5%) may apply as disclosed at the time of payment. Refunds are subject to our refund policy and applicable payment provider terms. Featured directory listings or other premium offerings may have separate pricing as described in the app or on our website.

7. Moderation and Termination

Community admins may moderate content and membership within their communities. We may remove content or suspend or terminate accounts that violate these terms or that we reasonably believe harm the Service or others. We may also modify or discontinue the Service or specific features with reasonable notice where feasible.

8. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Your use of the Service and any reliance on content or other users is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, UMMA Foundation and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars (USD 100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.

10. Indemnification

You agree to indemnify and hold harmless UMMA Foundation and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these terms or any law.

11. Governing Law and Disputes

These terms are governed by the laws of the jurisdiction in which UMMA Foundation is established, without regard to conflict of law principles. Any dispute arising from these terms or the Service shall be resolved in the courts of that jurisdiction, except where prohibited by law.

12. General

If any provision of these terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right. These terms constitute the entire agreement between you and UMMA Foundation regarding the Service. Our Privacy Policy describes how we collect and use your information and is incorporated by reference.
